SG Inc CPA (SG Inc CPA, we, us, or our) is committed to protecting the privacy and security of the personal and financial information you share with us. This Privacy Policy describes how we collect, use, disclose, and safeguard information obtained through our website located at www.sginccpa.com (the Site), our client portal, and in connection with the professional accounting, tax, and advisory services we provide.

Please read this Privacy Policy carefully. By using our Site or providing information to us, you acknowledge that you have read and understood this policy. If you do not agree with its terms, please do not use our Site or services.

This policy applies to residents of Texas, California, and all other jurisdictions in which we provide services. California residents are entitled to additional rights described in Section 8 of this policy.

IMPORTANT NOTICE: This Privacy Policy does not govern the use of client tax return information or client financial records provided to us for the purpose of preparing federal or state tax returns or providing other professional accounting services. Such information is governed by the Internal Revenue Code, applicable state laws, professional ethics rules, and the terms of your engagement agreement with SG Inc CPA. See Section 7 below for information regarding the use and disclosure of tax return information under Internal Revenue Code Section 7216.

1. Information We Collect

We collect information in several categories depending on how you interact with us.

1.1 Information You Provide Directly

When you contact us through our website, book a consultation, submit an inquiry form, or engage us for professional services, we may collect:

  • Identifying information: your name, email address, phone number, and mailing address
  • Business information: the name and type of your business, annual revenue, and entity structure
  • Financial and tax information: income figures, tax documents, financial statements, payroll records, and related materials provided in the course of a professional engagement
  • Account credentials: username and password if you access our secure client portal
  • Communication records: messages, emails, and notes from calls or meetings

1.2 Information Collected Automatically

When you visit our Site, we and our service providers may automatically collect:

  • Log data: IP address, browser type and version, operating system, referring URL, and pages visited
  • Device information: device identifiers, screen resolution, and hardware model
  • Usage data: pages viewed, links clicked, time spent on pages, and navigation paths

2.1 Providing Professional Services

To deliver the accounting, tax preparation, tax planning, bookkeeping, payroll, advisory, and related professional services for which you have engaged us, including preparing and filing tax returns, maintaining financial records, providing strategic tax and financial advice, and communicating with you and your representatives about your engagement.

2.2 Operating Our Site and Business

To respond to your inquiries, schedule consultations, send appointment confirmations and reminders, process your requests, manage our client relationships, conduct internal research and analytics, improve our services and website, and maintain the security and integrity of our systems.

2.3 Legal and Professional Compliance

To comply with applicable law, regulations, and professional standards, including obligations under the Internal Revenue Code, the Gramm-Leach-Bliley Act, the California Consumer Privacy Act, the Texas Business and Commerce Code, rules of the American Institute of CPAs (AICPA), the Texas Society of CPAs (TSCPA), the California Society of CPAs (CalCPA), and other applicable professional bodies.

2.4 Communications

To send you service-related communications such as engagement letters, tax notices, filing confirmations, and portal notifications. With your consent, we may also send newsletters, tax planning updates, educational content, and other communications relevant to your professional relationship with us. You may opt out of non-essential communications at any time.

2.5 SMS Communications

If you have opted in to receive text messages from SG Inc CPA, we may send SMS communications including appointment reminders, document request notifications, and other service-related messages. Message frequency varies. Message and data rates may apply. You may opt out at any time by replying STOP to any text message. We do not share or sell your SMS opt-in status or phone number with third parties for marketing purposes.

3. Legal Basis and Gramm-Leach-Bliley Act (GLBA) Notice

SG Inc CPA is a financial institution as defined under the federal Gramm-Leach-Bliley Act (GLBA) because we provide tax preparation and related financial services. The GLBA requires us to inform you of our privacy practices with respect to your nonpublic personal information.

We collect nonpublic personal information about you from the following sources: information you provide on forms, applications, and in the course of our service relationship; information about your transactions with us and our affiliates; and information we receive from consumer reporting agencies or other sources as permitted by law.

We do not disclose your nonpublic personal information to any nonaffiliated third party except as permitted by law, including as necessary to provide the services you have requested, to comply with legal requirements, or as you have specifically authorized.

We restrict access to your nonpublic personal information to those employees and contractors who need to know that information in order to provide services to you. We maintain physical, electronic, and procedural safeguards that comply with federal regulations, including the FTC Safeguards Rule, to protect your nonpublic personal information.

4. How We Share Your Information

We do not sell, rent, or trade your personal information to third parties for their marketing purposes. We may share your information in the following circumstances:

4.1 Service Providers

We may share information with trusted third-party service providers who assist us in operating our website, running our practice management systems, providing secure document transmission, processing payments, or delivering other services on our behalf. These service providers are contractually required to keep your information confidential and use it only for the purposes for which it was shared.

4.2 Professional and Legal Obligations

We may disclose information as required by law, regulation, court order, subpoena, or government request, or when we believe disclosure is necessary to protect our rights, prevent fraud, or protect the safety of our clients or the public. We may also disclose information to our professional liability insurer or legal counsel in connection with actual or potential claims.

4.3 Business Transitions

In the event of a merger, acquisition, sale of assets, or other business transition, client information may be transferred as part of the transaction, subject to the same privacy protections described in this policy and applicable professional ethics rules.

4.4 With Your Consent

We may share your information with third parties when you have given us explicit consent to do so, such as authorizing us to communicate with your attorney, financial advisor, lender, or other professional representative.

5. Disclosure of Tax Return Information — Internal Revenue Code Section 7216

Federal law under Internal Revenue Code Section 7216 and Treasury Regulation Section 301.7216 governs the use and disclosure of tax return information. Tax return information includes all information you furnish to us in connection with the preparation of your tax return, as well as the contents of the return itself.

We may use tax return information only to prepare your tax return and provide related tax compliance and advisory services, unless you provide written consent for other uses or disclosures. We will not use or disclose your tax return information for any purpose unrelated to tax return preparation or the associated professional services without your explicit consent, except as specifically permitted or required by law.

If you wish to authorize us to disclose or use your tax return information for purposes beyond tax return preparation, we will provide you with a written consent form that complies with Section 7216 requirements. Such consent is voluntary and may be revoked at any time.

6. Data Security and the FTC Safeguards Rule

SG Inc CPA is required to comply with the Federal Trade Commission’s Safeguards Rule, which applies to financial institutions that handle consumer financial information. In compliance with the Safeguards Rule and as a matter of professional responsibility, we maintain a written information security program that includes:

  • Designation of a qualified individual responsible for overseeing our information security program
  • Risk assessments to identify and evaluate risks to client information
  • Implementation of technical, physical, and administrative safeguards designed to protect client information
  • Encryption of client data in transit and at rest where feasible
  • Access controls limiting employee and contractor access to client information on a need-to-know basis
  • Regular monitoring, testing, and evaluation of our security controls
  • Staff training on information security practices and client confidentiality
  • Vendor management requirements for service providers who handle client information

Despite our security measures, no method of transmission or storage is completely secure. We cannot guarantee absolute security. If you suspect unauthorized access to your account or information, please contact us immediately.

7. California Privacy Rights (California Consumer Privacy Act / CPRA)

This section applies to California residents and supplements the rest of this Privacy Policy. It is provided pursuant to the California Consumer Privacy Act of 2018 (CCPA) as amended by the California Privacy Rights Act of 2020 (CPRA).

7.1 Categories of Personal Information Collected

In the preceding twelve months, we have collected the following categories of personal information from California residents:

  • Identifiers: name, email address, phone number, IP address, and business contact information
  • Personal information as defined in California Civil Code Section 1798.80: name, address, telephone number, financial account information
  • Financial information: bank account details, tax documents, income information, financial statements, and payroll records (collected only in the course of providing professional services)
  • Internet or network activity: browsing history on our Site, search history on our Site, and interactions with our Site
  • Professional information: business name, industry, revenue, and entity structure
  • Sensitive personal information as defined under the CPRA: Social Security numbers, tax identification numbers, financial account numbers, and other sensitive financial data collected solely for the purpose of providing professional accounting and tax services

We do not sell personal information to third parties. We do not share personal information for cross-context behavioral advertising purposes.

7.2 California Consumer Rights

Subject to certain exceptions, California residents have the following rights regarding their personal information:

  • Right to Know: You may request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources from which it was collected, the business purposes for collecting it, and the categories of third parties with whom it was shared.
  • Right to Delete: You may request that we delete personal information we have collected from you, subject to exceptions including information we are required to retain for legal, regulatory, or professional compliance purposes.
  • Right to Correct: You may request that we correct inaccurate personal information we maintain about you.
  • Right to Opt-Out of Sale or Sharing: We do not sell or share personal information for cross-context behavioral advertising. No opt-out action is required.
  • Right to Limit Use of Sensitive Personal Information: We use sensitive personal information only for the purposes necessary to provide the professional services you have requested and as required by law. We do not use sensitive personal information for purposes beyond those permitted by the CPRA.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your California privacy rights.

To exercise your California privacy rights, please contact us using the information in Section 12. We will respond to verifiable consumer requests within 45 days, with the possibility of a 45-day extension for complex requests. We will not charge a fee for processing requests unless they are excessive, repetitive, or manifestly unfounded.

Note: Certain personal information we hold is exempt from CCPA/CPRA because it is governed by other federal laws, including the Gramm-Leach-Bliley Act and the Internal Revenue Code. Information collected in the course of providing professional accounting and tax services is subject to those laws rather than the CCPA.

7.3 Authorized Agent

California residents may designate an authorized agent to submit requests on their behalf. We may require written proof of authorization and may verify the identity of both the consumer and the authorized agent before processing the request.

7.4 Shine the Light

California Civil Code Section 1798.83 (the ‘Shine the Light’ law) permits California residents to request information about disclosures of personal information to third parties for their direct marketing purposes. We do not disclose personal information to third parties for their direct marketing purposes.

8. Texas Privacy Rights

Texas residents may have certain rights under the Texas Data Privacy and Security Act (TDPSA) and other applicable Texas law. SG Inc CPA does not sell personal information. We do not process personal information for purposes of targeted advertising based on sensitive personal data.

Texas residents who believe their privacy rights under applicable Texas law have been violated may contact us using the information in Section 12. We will respond to verifiable requests in a commercially reasonable time. Please note that certain information we collect in the course of providing professional accounting and tax services is subject to federal law, including the GLBA, rather than state privacy law.

9. Retention of Information

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, including providing professional services, complying with legal and regulatory obligations, resolving disputes, and enforcing our agreements. For tax and accounting records, retention periods are generally governed by IRS and state agency requirements, applicable statutes of limitation, and professional standards, which typically require retention for seven years or longer for certain records.

When personal information is no longer needed, we take reasonable steps to securely destroy or de-identify it in accordance with applicable law and professional standards.

10. Cookies and Tracking Technologies

Our Site uses cookies and similar tracking technologies to improve your browsing experience, analyze Site traffic, and support certain Site functions. Cookies are small text files stored on your device when you visit our Site.

We use the following types of cookies:

  • Essential cookies: necessary for the Site to function correctly, including maintaining session state and enabling secure portal access
  • Analytics cookies: used to understand how visitors interact with our Site, including which pages are visited most frequently and how long visitors stay on each page. We use Google Analytics and similar tools for this purpose.

Our Site does not currently respond to browser Do Not Track signals.

Our Site may contain links to third-party websites, including our client portals hosted by SecureFilePro, scheduling tools, and other service providers. This Privacy Policy does not apply to those third-party websites. We encourage you to review the privacy policies of any third-party sites you visit. We are not responsible for the privacy practices or content of third-party websites.

12. Children’s Privacy

Our Site and services are not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information, we will delete it promptly. If you believe we have inadvertently collected such information, please contact us immediately.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, services, or applicable law. We will post the revised policy on our Site with an updated effective date. If we make material changes, we will provide additional notice as appropriate, such as a prominent notice on our Site or direct communication to our clients. Your continued use of our Site or services after any changes to this policy constitutes your acceptance of the revised terms.
